Questions
Yes. Under FEMA, non-resident Indians and OCI cardholders may purchase residential property in India without prior approval from the Reserve Bank of India. The only category restricted is agricultural land, plantation property and farmhouses, which this is not. You do not need to be present in India to complete the purchase.
Payment must be routed through normal banking channels — an inward remittance to the developer, or funds held in your NRE, NRO or FCNR account. Payment in foreign currency cash or by traveller's cheque is not permitted. Our team can share the exact remittance details and the FIRC documentation you will want to retain.
Yes, with conditions worth understanding upfront. Sale proceeds from property bought with inward remittance or NRE funds are repatriable, generally limited to the consideration paid in foreign exchange for up to two residential properties. Proceeds from NRO funds fall under the annual USD 1 million limit. Your own tax advisor should confirm how this applies to your situation.
When an NRI is the seller, TDS applies at a higher rate than for resident sellers. As a buyer you should also be aware of stamp duty and registration charges, which are payable in addition to the consideration. We will set these out in writing before you commit.
